zwolniony podczas urlopu bezpłatnego

Witam

W zeszłym roku skorzystałem z urlopu bezpłatnego tj. podpisano 12/05/12 że od 16/06/12 do 16/03/13 jestem w Polandii a później wracam do jukej Tesco. W międzyczasie dostałem p45 czyli podsumowanie mojej kariery za rok 2012 mimo trwania ww. urlopu. Czy to oznacza że zostałem zwolniony a jeśli tak to co teraz? (prócz uciechy z wolności) Zagranie chyba nie do końca w porządku ze strony T. Mam przepracowane ponad 5 lat więc powinny być jakieś normy prawne regulujące tego typu zachowania pracodawcy. Jakieś pomysły?

          WHAT’S THE NOTICE PERIOD?
          As much notice as possible or a minimum of 24 hours.
          WHO DO I ASK?
          Your Line Manager will support you to swap your shift. You
          will need to complete a Shift Swap Notification Form to
          confirm your Shift Swap arrangements.
          WHEN CAN I SWAP A SHIFT?
          Examples are for appointments that can’t be organised at
          another time, for school events or special occasions.
          Extended Holiday Leave
          Extend your holiday to a holiday of a lifetime, or for when you want time to visit relatives in far
          away places.
          WHO CAN APPLY?
          All staff.
          AFTER HOW LONG IN SERVICE?
          1 year.
          IS IT PAID OR UNPAID?
          Unpaid.
          HOW LONG DOES IT LAST?
          Up to 4 weeks added to an agreed paid holiday or taken
          separately. Limited to a maximum of 1 period
          of leave every 2 years (only one period of either a Lifestyle
          Break or Extended Holiday Leave can be taken in any given
          holiday year).
          WHAT’S THE NOTICE PERIOD?
          As much notice as possible or a minimum of 4 weeks.
          WHO DO I ASK?
          You will need to complete a Leave Request Form and pass it
          to your Line Manager. Your Line Manager will consider your
          request and will let you know if your leave can be agreed.
          Lifestyle Break
          To support you to take a break from work for a variety of lifestyle reasons.
          WHO CAN APPLY?
          All staff with a satisfactory performance record including
          absence for the previous year.
          AFTER HOW LONG IN SERVICE?
          1 year.
          IS IT PAID OR UNPAID?
          Unpaid.
          HOW LONG DOES IT LAST?
          Between 4 to 12 weeks in total (which includes a minimum of
          one weeks holiday attached to the leave). Limited to a
          maximum of 1 period of leave every 2 years (only one period
          of either a Lifestyle Break or Extended Holiday Leave can be
          taken in any given holiday year).
          WHAT’S THE NOTICE PERIOD?
          As much notice as possible or a minimum of 4 weeks.
          WHO DO I ASK?
          Speak to your Line Manager who will have more details. You
          will need to complete a Leave Request Form and pass it to
          your Line Manager. Your Line Manager’s Manager will
          consider your request and will let you know if your leave can
          be agreed.
          Career Break
          Supporting you when you need to take a longer break from work.
          WHO CAN APPLY?
          All staff.
          AFTER HOW LONG IN SERVICE?
          2 years.
          IS IT PAID OR UNPAID?
          Unpaid.
          HOW LONG DOES IT LAST?
          3 months to 5 years. Up to 2
          occasions totalling 5 years during
          your Tesco career.
          WHAT’S THE NOTICE PERIOD?
          At least 4 weeks.
          WHO DO I ASK?
          Speak to your Line Manager who
          will have more details or ask for
          the Career Break leaflet. You will
          need to complete a Leave Request
          Form and pass it to your Line
          Manager.
          Maternity Leave
          Your time with your new baby!
          WHO CAN APPLY?
          All expectant mothers.
          IS IT PAID OR UNPAID?
          Paid if you have over 26 weeks’ service*. If you have less
          than 26 weeks service you may still be eligible for maternity
          allowance.
          HOW LONG DOES IT LAST?
          Maternity Leave lasts for up to 1 year.*
          WHAT IS THE NOTICE PERIOD?
          At least 15 weeks before the baby is due – final notice
          required 28 days before the baby is due.
          WHO DO I ASK?
          Your Line Manager and Personnel Manager will support you
          with all the information that you need at this special time.
          *Pay type and amount varies based on length of service and earnings.
          Antenatal Leave
          Antenatal care is an important part of a healthy pregnancy.
          WHO CAN APPLY?
          All expectant mothers.
          AFTER HOW LONG IN SERVICE?
          Time off for antenatal care is available to any permanent or
          temporary employee from day of joining.
          IS IT PAID OR UNPAID?
          Paid.
          WHAT DOES THE TIME OFF COVER?
          Antenatal care includes standard visits to antenatal clinics,
          relaxation classes and parentcraft classes, as long as these are
          medically recommended by a registered medical practitioner.
          An appointment card will need to be produced.
          WHO DO I ASK?
          You must inform your Line Manager of any antenatal
          appointments.

            Nie sugeruję że po powrocie miałbym zapewniony pełny etat na tym samym stanowisku i w tym samym miejscu (miasto) co wcześniej. Uprzedzono mnie że bardzo możliwe a raczej na pewno będzie to inna miejscowość np. północ Anglii w zależności od zapotrzebowania i ja się z tym liczyłem. Mam to wszystko na papierze (tzn. zgodę na urlop od do) podpisaną przez menagiera personalnego. Problem w tym że bardzo szybko po powrocie do PL otrzymałem P45 mimo iż rok podatkowy się nie skończył. Dla mnie wygląda to jak zwolnienie z pracy bez wypowiedzenia ze strony pracodawcy czyli bez żadnego powodu (nie wiem czy zasady i prawa nie zostały złamane). Nie bardzo wiem co robić w tej sytuacji. Pytanie co robić w takiej sytuacji i gdzie skierować się po pomoc. Dzięki.

          Ślad jest w postaci umowy pisemnej w której są zawarte moje dane oraz Tesco z datą sporządzenia umowy jak również od kiedy do kiedy ma ten urlop trwać a nawet jeśli chciałbym podczas tego urlopu tymczasowo pracować dla Tesco powinienem skontaktować się z menagierem swojego sklepu. Reasumując umowa zawiera wszystkie najważniejsze postanowienia sporządzone na papierze Tescowym wraz z podpisem men. personalnego.

      Every treatment procedure is different. Your Line Manager/
      Personnel Manager will support you to arrange the time off
      that you need.
      IS IT PAID OR UNPAID?
      Paid and unpaid leave can be agreed. Staff with over 1 year’s
      service may be eligible for paid leave.
      HOW MUCH NOTICE DO I NEED
      TO GIVE?
      As much as possible so we can help you to plan this time off.
      HOW DO I FIND OUT MORE?
      Speak to your Line Manager or Personnel Manager for more

      Foster Care
      Support if you are undergoing the application and training to become a Foster Carer.
      WHO CAN APPLY?
      Staff registered as a foster carer, or who are applying to
      become a carer with a Foster Care agency or Local Authority.
      AFTER HOW LONG IN SERVICE?
      26 weeks.
      IS IT PAID OR UNPAID?
      Paid.
      HOW LONG DOES IT LAST?
      Up to 5 days (pro-rata for part time staff).
      WHAT IS THE NOTICE PERIOD?
      At least 28 days.
      WHO DO I ASK?
      Speak to your Line Manager for more information. You will
      need to complete a Leave Request Form and pass it to your
      Line Manager
      Parental Leave
      Support for staff who want to take time away from work to look after a child or to make
      arrangements
      for the good of a child.
      WHO CAN APPLY?
      To be eligible you must have at least 1 year’s service and:
       Be the parent of (or have acquired formal parental
      responsibility for) a child who is still under 5 years old,
      Or
       Have adopted a child within the last 5 years, and the child
      must be under 18 years of age,
      Or
       Be the parent of a disabled child born after 15th December
      1999, who is under 18 years of age.

      1 year.

                syf jak syf i najbardziej mnie rozbawiaja ze wszystko zwalaja na kadry w indiach :)
                a wszystko maja do dyspozycji na miejscu, jak chciałem zaswiadczenie o dochodach to myslalem ze troche potrwa przez te magiczne indie ale okazuje sie ze wypelnili tak jak umieli (wersja po angielsku z polskiego banku byla dla nich nie zrozumiała ale to inna sprawa)

                ale wracaja do kolegi od p45 to powinien przedzwonic do swojego sklepu z pytaniem o co chodzi , mozliwe ze go zwolnili skoro dostal p45 , ale wypadałoby zeby pisemnie mu tez wysłali wypowiedzenie. zalezy tez co ma napisane w tym pismie czy mu gwarantuja powrot etc. kolezanke zwolnili podczas ktoregos z ...break ale była w ciazy wiec raczej bylo pewne ze tak zrobia bo chciała ...break do porodu a pozniej maternity. mnie manago powiedział ze on moze do 3 miesiecy zagwaratnowac miejsce potem ...???? bo myslalem zeby wziasc roczny career break i poszukac pracy w Polsce ale chyba na razie sie wstrzymam. chociaz czasem chce sie walnac tym wszystkim
