Protocol on the enlargement of the European Union

Article 3

Provisions concerning the weighting of votes in the Council

1. On 1 January 2005:

(a)
in Article 205 of the Treaty establishing the European Community and in
Article 118 of the Treaty establishing the European Atomic Energy Community:

(i)
paragraph 2 shall be replaced by the following:

"2. Where the Council is required to act by a qualified majority, the votes
of its members shall be weighted as follows:

Acts of the Council shall require for their adoption at least 169 votes in
favour cast by a majority of the members where this Treaty requires them to
be adopted on a proposal from the Commission.

In other cases, for their adoption acts of the Council shall require at least
169 votes in favour, cast by at least two-thirds of the members."



(ii)
the following paragraph 4 shall be added:

"4. When a decision is to be adopted by the Council by a qualified
majority, a member of the Council may request verification that the Member
States constituting the qualified majority represent at least 62 % of the
total population of the Union. If that condition is shown not to have been
met, the decision in question shall not be adopted."



(b)
In Article 23(2) of the Treaty on European Union, the third subparagraph
shall be replaced by the following text:

"The votes of the members of the Council shall be weighted in accordance with
Article 205(2) of the Treaty establishing the European Community. For their
adoption, decisions shall require at least 169 votes in favour cast by at
least two-thirds of the members. When a decision is to be adopted by the
Council by a qualified majority, a member of the Council may request
verification that the Member States constituting the qualified majority
represent at least 62 % of the total population of the Union. If that
condition is shown not to have been met, the decision in question shall not
be adopted."



(c)
In Article 34 of the Treaty on European Union, paragraph 3 shall be
replaced by the following:

"3. Where the Council is required to act by a qualified majority, the votes
of its members shall be weighted as laid down in Article 205(2) of the Treaty
establishing the European Community, and for their adoption acts of the
Council shall require at least 169 votes in favour, cast by at least two-
thirds of the members. When a decision is to be adopted by the Council by a
qualified majority, a member of the Council may request verification that the
Member States constituting the qualified majority represent at least 62 % of
the total population of the Union. If that condition is shown not to have
been met, the decision in question shall not be adopted."

2. At the time of each accession, the threshold referred to in the second
subparagraph of Article 205(2) of the Treaty establishing the European
Community and in the second subparagraph of Article 118(2) of the Treaty
establishing the European Atomic Energy Community shall be calculated in such
a way that the qualified majority threshold expressed in votes does not
exceed the threshold resulting from the table in the Declaration on the
enlargement of the European Union, included in the Final Act of the
Conference which adopted the Treaty of Nice.

      Artykuł 24: Większość kwalifikowana

      1. Jeżeli Rada Europejska lub Rada Ministrów podejmuje decyzje większością
      kwalifikowaną, taką większość stanowi większość Państw Członkowskich,
      reprezentująca co najmniej trzy piąte ludności Unii.

      2. Jeżeli Konstytucja nie wymaga aby Rada Europejska lub Rada Ministrów
      stanowiły na wniosek Komisji lub jeżeli Rada Europejska lub Rada Ministrów nie
      stanowi z inicjatywy Ministra Spraw Zagranicznych Unii, wymaganą większość
      kwalifikowaną stanowią dwie trzecie Państw Członkowskich, reprezentujących co
      najmniej trzy piąte ludności Unii.

      3. Postanowienia ustępów 1 i 2 wchodzą w życie 1 listopada 2009 roku, po
      przeprowadzeniu wyborów do Parlamentu Europejskiego, zgodnie z postanowieniami
      artykułu 19.

      4. Jeżeli w części III Konstytucja przewiduje, że ustawy europejskie i
      europejskie ustawy ramowe są uchwalane przez Radę Ministrów zgodnie ze
      szczególną procedurą ustawodawczą, Rada Europejska może przyjąć, z własnej
      inicjatywy oraz jednomyślnie, po co najmniej sześciomiesięcznym okresie
      rozpatrywania, decyzję zezwalającą na przyjęcie takich ustaw europejskich i
      europejskich ustaw ramowych zgodnie ze zwykłą procedurą ustawodawczą. Rada
      Europejska stanowi po konsultacji z Parlamentem Europejskim i poinformowaniu
      parlamentów narodowych.

        Czyli najwazniejsze wydaje mi sie wywalczenie komisarza w ue dla Polski. A o

          Powrót do zasady "jeden kraj - jeden komisarz" podobno jest już przesądzony -
          Prodi i Giscard przestali obstawać przy artykule konstytucji zmieniającym tę
          zasadę.

      Nicejski podzial głosów dla państw przystępujących do UE, w nawiasie liczba

      Polska (38,7mln) -27 głosów;
      Czechy (10,3mln), Węgry (10,1mln) - po 12 głosów;
      Słowacja (5,4mln), Litwa (3,7mln) - po 7 głosów;
      Łotwa (2,4mln), Słowenia (2mln), Estonia (1,4mln), Cypr (0,8mln) - po 4 głosy;
      Malta (0,4mln) - 3 głosy.

      Jak widać, "nicejskie wagi" są korzystne nie tyle dla Polski, co dla tzw. euro-
      maluchów. Dziewiątka pozostałych (prócz Polski) krajów, licząc łącznie o 3 mln
      mniej ludzi niż my, będzie mieć razem 57 głosów, ponaddwukrotnie więcej! Ci,
      którzy krzyczą "Nicea albo śmierć" powinni chyba wziąć na uspokojenie...

      Traktat Nicejski uwzględnia też dwa państwa, które mają przystąpić do UE ok
      2007 roku:

      Rumunia (22,5mln) - 14 głosów;
      Bułgaria (8,2mln) - 10 głosów.
Pełna wersja
