EPSO IS NOT COMPETENT!
THE CIVIL SERVICE TRIBUNAL HAS ANNULLED EPSO'S DECISION TO EXCLUDE A
CANDIDATE WHO HAD NOT PASSED THE PRE‑SELECTION TESTS FOR A GENERAL
COMPETITION
In its ruling of 15 June 2010 on case F-35/08, the Civil service
Tribunal declares that:
«EPSO IS NOT COMPETENT TO CARRY OUT (...) TASKS (...) RELATING TO
THE DETERMINATION OF THE CONTENT OF TESTS AND THEIR CORRECTION,
INCLUDING TESTS BASED ON MULTIPLE CHOICE QUESTIONS».
The Tribunal underlines that this is all the more inappropriate if:
"THE NUMBER OF CANDIDATES ADMITTED TO PARTICIPATE IN [subsequent]
TESTS IS ONLY A MINUTE PERCENTAGE OF CANDIDATES IN THE PRELIMINARY
PHASE".
As the Tribunal states in paragraph 61 of its ruling, "a procedure
that leads to the exclusion of more than 90% of candidates, not for
formal reasons, but because they did not reply in a sufficiently
satisfactory manner to tests, is part of the very essence of a
competition".
