hej!dostalem zaproszenie na medical a potem RDV w ADMIN-ie. wiem ze
normalnie funkcjonariuszom przysluguje 16% w zwiazku z
przeniesieniem sie z kraju do Bxl. tylko ze jaa zyje w bxl juz od
kilku lat, nie pracujac dla instytucji. wiem ze jest cos takiego jak
center of interst ktore mozna wykorzystac, zeby dostac te 16%. czy
ktos byl w takiej sytuacji? czy wiecie co zrobic by przekonac Admin
do przyznania tego 16% allowance? wszelkie wskazowki b.mile
widziane! dzieki!

      Jezeli mieszkasz w Bxl to niestety 16% przepadlo i nic Adminu juz
      nie przekona. Center of intrest nie ma wplywu na te 16% tylko
      ewentualnie na prawo do corocznej podrozy, jesli sie nie myle.

      Ja nie mam zadnych dodatkow,bo wlasnie zylam wczesniej w Belgii i
      takich przypadkow jest duzo....Skoro nie nalezy sie to nie kombinuj
      tylko ciesz sie z tego co masz....bo to nie jest wcale malo.To
      pewnie wiesz,skoro zyjesz tu w Belgii.Jezeli masz belgijskie
      obywatelstwo to nie masz co marzyc ani o 16% ani o 4%
      Jezeli masz belgijska karte pobytu (zolta,biala,niebieska) to
      mozesz "zawalczyc" o 4%. Tylko uwazaj,bo nawet jezeli osoba
      zajmujaca sie twoja dossier przyzna ci to po jakims czasie ktos moze
      dopatrzyc sie i....znam taki przypadek,ze dziewczyna musiala zwrocic
      roznice,bo dopatrzono sie po roku

        To zalezy ile lat jestes w Brukseli i gdzie pracowales. Jesli dla
        innego kraju np. (ambasadzie, instytucje rzadowe etc) to nie ma
        zadnego problemu z otrzymaniem tego dodatku.

          jesli jestes nie dluzej niz 5 lat w Brukseli to dostaniesz, inaczej
          pewnie tylko 4%.

            Franca ma racje- 5 lat to jest ta granica, wiec jesli jestes w BE
            krocej to ci 16 proc przysluguje..co do 4 dodtkowych dni (to jest
            zwiazane z centre of interest) to jesli udowodnisz ze jest ono gdzie
            indziej niz w Bxl (np przedstawiajac rachnuki za prad twoich
            rodzicow) to tez je dostaniesz

              mieszkalam w BE wczesniej ponad rok- mam dodatek ekspatriacyjny- 16%.

              tak, jak pisali poprzednicy, wydaje mi sie, ze gorna granica to jest
              5 lat.

      dziekuje wszystkim za super wazne info! wydaje sie wiec ze 4 dni
      dodatkowego urlopu powinienem dostac (centre of interest)a co do
      dodatku to sie zobaczy. jestem tu dluzej niz 5 lat ale z przerwa,
      ktora moze mi zalicza ;-) dzieki wielkie i pozdrawiam!

        Ja jestem tu......duzo duzo wiecej i tez mi zaliczyli pochodzenie
        (podobnie jak wielu moim znajomym w takiej sytuacji).Juz radze ci
        zbierac rachunki rodzicow za telefon,wode,gaz,za mieszkanie i zaraz
        na poczatku pracy wypelnic odpowiedni dokument i starac sie o te
        zmiany-masz prawo do kilku dni dodatkowego urlopu+ tzw ekwiwalentu
        na dojazd dla ciebie i twojej rodziny.Mozesz rowniez starac sie juz
        pracujac o comiesieczny dodatek na rodzicow,a nawet w specjalnych
        przypadkach na rodzenstwo

          The expatriation allowance is paid:

          to officials:
          who are not and have never been nationals of the State in whose
          European territory the place where they are employed is situated,
          and
          who during the five years ending six months before they entered the
          service did not habitually reside or carry on their main occupation
          within the European territory of that State. For the purposes of
          this provision, circumstances arising from work done for another
          state or for an international organisation are not taken into
          account;
          to officials who are or have been nationals of the State in whose
          territory the place where they are employed is situated but who
          during the 10 years ending at the date of their entering the service
          habitually resided outside the European territory of that State for
          reasons other than the performance of duties in the service of a
          state or of an international organisation.
          What am I entitled to? The expatriation allowance is equal to 16% of
          the total amount of the basic salary plus household allowance and
          the dependent child allowance. The minimum amount of the
          expatriation allowance is laid down in Article 69 of the Staff
          Regulations.

            Place of origin, place of recruitment and centre of interests
            (definitions and conditions)
            Changing the place of origin within a year of taking up duties
            Changing the place of origin while in service
            Whom to contact?
            Place of origin, place of recruitment and centre of interests
            (definitions and conditions) The place of origin as referred to in
            Article 7(3)(1) of Annex VII to the Staff Regulations is used to fix
            various financial entitlements for officials and temporary staff
            (annual travel expenses, travelling time, travel expenses and
            removal expenses on termination of service, etc.).
            An official's place of origin is fixed or changed by the appointing
            authority according to the criteria laid down in the Commission's
            Decision of 15 April 2004. These criteria are as follows:

            1. When you take up your duties, your place of origin is assumed to
            be the place from where you are recruited.
            If you so request within one year of taking up your duties, and on
            production of appropriate documentary evidence, your centre of
            interests can be fixed as your place of origin, if the centre of
            interests is not the same as the place of recruitment.

            2. For the purposes of applying the above Decision:

            "place of recruitment" means the place where you were habitually
            resident at the time of recruitment. Places of temporary residence,
            e.g. for the purpose of study, military service, training periods or
            holidays, are not regarded as places of habitual residence;
            "centre of interests" means the place where you retain:
            (a) your main family ties which, barring duly substantiated
            exceptions, mean:
            1. your mother and father or either parent; failing that
            grandparents, or one grandparent; failing that parents-in-law, or
            either parent-in-law; failing that brothers and sisters;
            or children, or one or more of them

            2. the marital residence, on the dual condition that:
            - it was your permanent joint residence prior to the first spouse's
            entry into the service of the Communities as a permanent official or
            as a member of the temporary, auxiliary or contract staff of an
            Institution, and
            - it consists of immovable property in which you have, or one of you
            has, heritable interests;

            (b) heritable interests constituted by immovable property in the
            form of buildings;

            (c) essential civic interests, both active and passive.
            If all three criteria referred to in a), b) and c) are not fulfilled
            by the same place, your centre of interests is taken to be the place
            where at least two of the three criteria are met or, failing that,
            the place where you retain your main family ties, confined in this
            instance to the official's father, mother or children.

            3. If your centre of interests cannot be established by means of the
            above criteria, your place of recruitment is fixed as the place of
            origin.

            4. If you move from one Community Institution to another, your place
            of origin continues to be that fixed by the previous Institution.

            Changing the place of origin within a year of taking up duties You
            may do this by sending a note to the department responsible,
            accompanied by appropriate documentary evidence relating to the
            criteria corresponding to your situation, such as:

            (a)
            1. a certificate of residence and copy of a recent utility bill in
            the name of your parents or grandparents, etc.;

            2. a certificate of joint residence at that time + a copy of the
            notarial deed + a bill for the property;

            (b) a copy of the notarial deed + a bill for the property (in your
            name);

            (c) a copy of your polling card or certificate of registration on
            the electoral register.

            Changing the place of origin while in service If you so request, by
            note to the department responsible, and produce appropriate
            documentary evidence, your place of origin may exceptionally be
            changed during your period of employment.

            Such changes cannot be allowed unless all the factors taken into
            account for determining your centre of interests have ceased to
            exist and another centre of interests can be fixed in accordance
            with conditions referred to in the second indent of Article 2(2).

            If your place of recruitment has been fixed as the place of origin,
            the same conditions apply with regard to a pre-existing centre of
            interests which was not taken into account when determining the
            place of origin.

            If your centre of interests moves to a place outside the territories
            of the Member States of the Communities or of the overseas countries
            and territories listed in Annex IV to the Treaty establishing the
            European Economic Community, your place of origin may by special
            decision of the appointing authority be changed, for the purpose of
            applying Article 7(1)(b), Article 8 and Article 9(2) of Annex VII to
            the Staff Regulations, so as to fix your place of origin at a point
            on the frontier of the territories of the Communities on the direct
            route to the centre of interests.

            Once you reach the age of 55 you may, in preparation for retirement,
            request that your place of origin be changed, on production of
            appropriate documentary evidence relating to heritable interests in
            the form of immovable property already built or under construction.

            Upon termination of service and in the light of your place of
            resettlement, your place of origin may be changed at your request
            and on production of appropriate documentary evidence, by special
            decision of the appointing authority (property deeds + recent bills).

            Following termination of service, for family or medical reasons,
            officials who enter the service before 1 May 2004 and are not
            receiving a pension at that time may exceptionally request the
            appointing authority to change their place of origin. This decision
            shall be taken on production of appropriate supporting evidence by
            the person concerned.
