Drogie operki! Jako studentka prawa postanowilam pokopac w papierach i
podowiadywac sie, jakie sa mozliwe konsekwencje wyjazdu na czarno. Bo jak juz
ktos sie na taki wyjazd decyduje, powienien wiedziec, co ryzykuje. Moze Wy
tez cos na ten temat wiecie? Kazdy kraj ma inne regulacje, postaram sie
czegos wiecej dowiedziec (moze nie dzisiaj, ale stopniowo fajnie byloby cos
tutaj dopisywac)

      Z tego co czytalam, to za nielegalna prace w USA grozi kara finansowa dla
      rodzinki (jeszcze dokladnie nie wiem jaka, ale sie dowiem), natomiast operka
      zostaje deportowana. Problemy moga pojawic sie juz na lotnisku (np. ladujemy
      sobie zadowolone w Nowym Jorku i nas od razu zawracaja do Polski).

      W Niemczech ostatnio zaostrzono przepisy za nielegalna prace i kary podniesiono
      nawet do 5000 Euro. Co jest jeszcze wazne, niemcy lubuja sie w donosicielstwie -
      jak juz kilku osobom pisalam - jak robie ze znajomymi impreze, to juz o 22.05
      (23.05) pojawia sie policja, wezwana przez sasiadow - studentow, ze im sie
      cisze nocna zakloca. Jak piesek zrobi "kupe" komus pod oknem, od razu
      zawiamiana jest policja i delikwent placi (chyba teraz 50 Euro - ostatnio moja
      znajoma placila :))) Nie, zeby to byl jakis absolutny standard, ale zawsze jest
      takie ryzyko - czemu zazdrosny sasiad mialby nie zadzwonic i nie powiedziec, ze
      rodzina X ma nielegalnego pracownika??

        a wlasciwie jak moga to sprawdzic?mozna powiedziec ze jest sie u znajomych w
        celu podszkolenia jezyka...no i nawet jesli sie pomaga przy dzieciach-to
        niekoniecznie musi byc w ramach pracy-a jesli ktos jedzie do rodziny i robi to
        samo [i mu placa-kto moze o tym wiedziec?]to juz nie jest praca na czarno?
        mozna udowodnic ze ktos pracuje w ten sposob na czarno?

          PENALTIES FOR ILLEGAL AU PAIR WORK
          Penalties Suffered by the Illegal Au Pair

          Persons traveling to the United States under the Visa Waiver Program (e.g.,
          Swedish citizens traveling without a visa as tourists or on short-term business
          for their non-U.S. employer) are permitted to stay in the U.S. no more than 90
          days. Persons traveling to the United States with a visa are generally allowed
          to remain in the U.S. for a longer period, though the exact amount of time is
          left to the discretion of the Department of Homeland Security (DHS) officer
          interviewing the alien upon his or her arrival in the United States. In neither
          case, though, unless the prospective au pair has been appropriately issued a J-
          1 or B-1 visa, may an alien be employed as an au pair during the period of his
          or her stay.

          Should an alien traveling to the U.S. - under either the Visa Waiver program or
          with a visa - stay longer than amount of time allowed the alien by the
          Department of Homeland Security (DHS), he or she will be considered by the DHS
          to be unlawfully present in the United States. The DHS is authorized to deport
          any alien who has overstayed his or her allowed period of stay in the United
          States. Moreover, should the alien overstay his or her allowed period in the
          U.S., voluntarily leave the country, then seek to re-enter the U.S. at a later
          date, the DHS may not readmit the alien into the U.S.; the alien may be sent
          back - at his or her own expense - to the country from which the alien traveled
          to the U.S.


          Penalties Suffered by Those Employing an Illegal Au Pair

          It is unlawful for a person or other entity to knowingly hire for employment in
          the United States an alien au pair that has not received work authorization.
          Any person found by the DHS to have knowingly hired an illegal au pair may face
          civil penalties of up to $2000 for a first offense, with escalating fines up to
          $10,000 for subsequent offenses. Any person convicted of engaging in a pattern
          or practice of hiring unauthorized au pairs shall also face criminal penalties
          including fines of up to $3,000 for each illegal au pair that the person
          employed and imprisonment for up to six months.

          Should an alien travelling to the U.S. - either under the Visa Waiver Program
          or with a visa - work as an au pair in the U.S. at any time before or after the
          expiration of the allowed period of stay, he or she will have violated U.S.
          work authorization laws. As with the case of an overstay, the United States
          Citizenship and Immigration Services (USCIS) is authorized to deport any alien
          who is working in the United States without proper authorization. Moreover,
          should the alien work without authorization during his or her allowed period in
          the U.S., voluntarily leave the country, then seek to re-enter the U.S. at a
          later date, the United States Citizenship and Immigration Services (USCIS) may
          not readmit the alien into the U.S.; the alien may be sent back - at his or her
          own expense - to the country from which the alien traveled to the U.S.

        Pomylka:

        Eine illegale Beschäftigung von Aupairs (ohne Arbeitsgenehmigung) wird mit
        hohen Strafen bis zu geahndet werden (bis 20.000,- Euro). Die Behörden
        kontrollieren zunehmend Familien, ob illegale Arbeit in Familien stattfindet.
        Wir raten dringend davon ab und empfehlen unseriöse Agenturen zu meiden.
