FIRST PROMOTION AFTER RECRUITMENT :
Article 45 (2) of the STAFF REGULATIONS
2008 : The last year for getting a promotion at level 4. Next year, that will
be finished
– see administrative information N° 16/2007 of 17.02.2007.
A brief reminder : since the implementation of the new Staff Regulations,
Article 45 (2) provides :
Officials shall be required to demonstrate before their first promotion after
recruitment the ability to work in a third language among those referred to in
Article 314 of the EC Treaty. The institutions shall adopt common rules by
agreement between them for implementing this paragraph. These rules shall
require access to training for officials in a third language and lay down the
detailed arrangements for the assessment of officials’ ability to work in a
third language, in accordance with Article 7(2)(d) of Annex III.
SE does not in any way contest the fact that work has to be done in several
languages in the institutions. However, we consider it a matter for regret
that this was not made known to our future colleagues straight away,
particularly in the notice of the concours itself Indeed, how many risk
suffering disadvantage through simple lack of awareness of the problem, in
addition to the fact that they are already seriously disadvantaged by the
recruitment levels which are significantly lower than in the past. Is this
problem at least brought out in the training and information sessions given to
new arrivals ?
In any case, the obligation to learn a third language is certainly seen by the
services as a handicap at the time of appointment, given the permanent
shortage of staff in the services themselves : after all, what Head of Unit
would want to recruit someone who will spend 40 hours of obligatory training
at each level, plus the hours of revision necessary to sit the examination
successfully ?
Colleagues already in place must reach language level 4 and this will be the
case up to 31.12.2008 ; from next year onwards, it will be level 6.
Colleagues promoted with level 4 will, however, have to reach level 6 as
quickly as possible; inscription at that level in the training record remains
a priority on the basis of this article of the Staff Regulations throughout
the year following promotion.
Therefore, SE invites you to take note, before it is too late, of this
situation which is important if you are not to lose several extra years before
a possible promotion :
If you have a third language at the time of recruitment, we recommend that you
check the validity of any corresponding language certificate with EPSO. If
you have no certificate but consider that your knowledge meets the required
standard, ask to sit a language test.
If this is not your case, you have different options, in particular :
- to request directly a course of training in a language which must be
different from the two other languages used in your concours. These requests
for language training are a priority under Article 45(2) of the Staff
Regulation (reference to this will appear in SYSPER 2 and in the training
map). It is obligatory to mention this in any request for a language course.
Your Human Resources unit cannot under any circumstances refuse a request, and
in fact has to be the first to raise this with you.
- choose a language school validated by EPSO, in order to sit a language test
at that establishment.
§ In the context of evaluations, the obligation to follow language
courses under Article 45(2) of the Staff Regulations cannot under any
circumstances be invoked to act as a brake on your objectives.
§ Finally, these provisions are equally applicable to Contract Agents
in Function Group IV to obtain an indefinite-duration contract.
