Child Benefit - a maternity leave w Polsce

Czy ktos moglby mi pomoc w znalezzieniu jednoznaczniej odpowiedzi na
nastepujace pytanie: czy matka, ktora urodzi dziecko w Polsce i tam spedzi
zarowno platny, jak i bezplatny maternity leave ( w sumie 39 plus 26
tygodni), a ktora byla przez poprzedni rok zatrudniona legalnie w UK, ma
prawo do Child Benefit? Planuje urodzic dzecko w Polsce i spedzic tu
macierzynski, nie bede miala wiec adresu zamieszkania w Anglii. Mam jednak
konto bankowe, bede otrzymywac na nie regularne wplywy (SMP), mam NIN,
formalnie jestem nadal zatrudniona przez mojego pracodawce, i mam prawo
powrotu do tej samej pracy po zakonczeniu macierzynskiego.

Przegladam rozne zrodla i gubie sie, bo zdania sa podzielone. Wydaje mi sie,
ze skoro mam ciaglosc zatrudnienia i przysluguje mi zarowno OML jak i AML to
przysluguje mi takze Child Benefit. Na chwile obecna nie wiem czy po
zakonczeniu macierzynskiego wroce do pracy w Anglii, i na moja logike wyglada
to tak, ze gdybym miala nie wrocic do pracy, to z ta chwila nie mam mowy o
Child Benefit. Ale co z okresem urlopu macierzynskiego? I jak w sytuacji
urodzenia dziecka w Polsce starac sie o przyznanie benefitu? Oczywiscie w
Polsce nie otrzymywalabym zadnych swiadczen na dziecko.

      Ja tylko dodam w sprawie powrotu do pracy: po 26 tygodniach masz prawo powrotu
      do tej samej pracy. Po 52 tygodniach juz nie, tyle ze pracodawca ma obowiazek
      zapewnic ci posade w firmie o nie mniejszych zarobkach i nie gorsza niz poprzednia.

      Co do reszty niestety nie wiem.

      Child Benefit (CHB)
      Yes If the visit is temporary, CHB remains payable for up to 8 weeks.

      Special rules apply for a longer absence

      No If the person receiving CHB or the child for whom it is payable leaves Great
      Britain permanently, payment stops from the date of departure.

      Musisz sie po prostu z nimi skontaktowac, ale z twojego postu wynika (takie mam
      wrazenie) ze rozwazasz mozliwosc pozostania w PL, w tym wypadku ChB ci nie
      przysluguje. To ze PRZED urodzeniem dziecka pracowalas w UK nie ma znaczenia,
      bo ChB jest dla dziecka (ktore w twoim przypadku urodzi sie w PL i tam razem z
      toba pozostanie), a nie dla rodzicow, teoretycznie, dlatego tez wystepuje sie o
      ten zasilek po urodzeniu dziecka, a nie jak jestes w ciazy.

      You must tell HM Revenue & Customs straight away if you, your child, children
      or all of you leave the UK permanently or for an absence that is likely to last
      for more than a year when you leave. If you are going abroad permanently but
      your child is staying in the UK and living with someone else, the person they
      are staying with should get in touch with HM Revenue & Customs and claim Child
      Benefit.

      You will be treated as being abroad temporarily if your absence is unlikely to
      last for more than a year when you leave. If you go abroad temporarily, you can
      continue to get child benefit:

      · for up to 8 weeks, whatever the reason for your absence
      · for the first 12 weeks you are abroad if you go or stay abroad because
      you are, or a member of your family is, receiving treatment for an illness or
      disability or because a member of you family has died.

      You must tell HM Revenue & Customs if you are going abroad longer than this.

      If your child goes abroad for up to 12 weeks, you can continue to get Child
      Benefit for them for those 12 weeks. You must tell HM Revenue & Customs if your
      child is leaving the UK for more than 12 weeks. If your child is abroad for
      more than 12 weeks (but not permanently), you may still get Child Benefit if
      they are abroad only for one of the following reasons.

      · To receive full-time education in an EEA country or Switzerland.
      · For an educational visit that their school approves in writing.
      · To get medical treatment for an illness that began before the child
      left the UK.

      Special rules may apply if you are:

      · leaving the UK to live or work in another EEA Country or Switzerland,
      or
      · a UK Crown Servant posted overseas or their partner.
