CZY ktos sie orjetuje czy teraz jak sklada sie podanie o housing
benefit prosza o wypelnienie tego testu czy nie??

Trzeba mieć ten test zdany żeby się ubiegać o HB. Tzn można dostać i pobierać długi czas HB ale jak,,odkryją,,że nie masz zdanego testu tzn.you dont have a right to reside in UK to zwracasz całą kwotę którą Ci wypłacili.

A to nie dotyczy tylko income support?Czekam wlasnie na decyzje o przyznanie
local housing allowance i nie wiem co mam teraz zrobic?pierwszy raz slysze o

zapytac?
Wez jeszcze pod uwage ze zaleznie od councilu wymogi moga byc rozne.

Byłam w councilu w zeszły piątek i bywam często i pierwsze słyszę,
że trzeba mieć zdany ten test ubiegając się o HB. Test ten się zdaje
składając papiery na Income Support lub Job Seekers Allowance.

claimant is required to satisfy the habitual residence test to be eligible for
Income Support, income-based Jobseeker’s Allowance, State Pension Credit,
Housing Benefit and Council Tax Benefit (“income-related benefits”). It was
introduced to prevent “benefit tourism” by people who come here from abroad
and immediately claim income-related benefits. Its purpose is to ensure that
income-related benefits are paid to people with reasonably close ties to the UK
and an intention to settle here. From 1st May 2004, a claimant also had to have
a right to reside in order to satisfy the habitual residence test. The right to
reside part of the test was further modified from 30th April 2006 so that certain
rights to reside do not satisfy that aspect of the test.
7.2 There are a number of categories of person who are exempt from the test:
• workers, self-employed persons, persons who retain either status and their
family members for the purposes of Council Directive No. 2004/38/EC;
• people with a right to reside permanently in the UK by virtue of Article 17
of that Directive;
• nationals from one of eight of the member States that acceded to the
European Union on 1st May 2004 who are workers by virtue of the Home
Office Worker Registration Scheme;
• those who have been granted refugee status;
• persons who have been granted exceptional leave to enter the United
Kingdom by an immigration officer, or to remain in the United Kingdom
by the Secretary of State;
• those who have been deported or otherwise compulsorily removed from
another country to the UK;
• people who have left Montserrat since November 1995 because of the
volcanic eruption; and
• people who have left Lebanon on or after 12th July 2006 because of the
armed conflict there (this exemption will cease on 31st January 2007).

Tak jak napisałam wcześniej ten test musi być zdany.Ja o tym nie wiedziałam
złożyłam podanie o HB, przyznali mi a teraz po długim czasie pobierania kazali
mi wszystko zwrócić :(

No, chyba, że nie jesteś zajerestrowana.

To taka sama sytuacja jak z CHB. Kto legalnie pracuje w UK ma prawo do CHB
nawet, jeśli dziecko jest w Polsce. Natomiast niektórzy "inaczej zorientowani"
urzędnicy potrafią to podać jako powód do odmowy. (zamieszkanie dziecka w
Polsce) Więc raczej szukaj dalej, bo niektórzy nie wiedzą, że Polska jest w Unii
Europejskiej.

taka sytuacja?

To jest taki 'sprawdzian' na to ze jestes rezydentem UK, a nie wpadlas na chwile
i z miejsca udajesz sie do panstwa po zapomogi. Wszystkie benefity z puli
socjalnej, czyli te nie zwiazane z podatkami (tax credits etc) moga byc
teoretycznie przyznane potrzebujacym po udokumentowanych 12 mies pobytu i pracy
w UK :)

Habitual Residence Test

The resources under this keyword include information about the Habitual
Residence test. This is a test to establish whether a welfare benefits or
homelessness applicant who has recently returned to the UK after living abroad
has a 'centre of interest' in the Common Travel Area (which consists of the UK,
Republic of Ireland, Channel Islands and the Isle of Man).

The test looks at whether the applicant’s residence in the UK is of a settled
nature, the length and continuity of residence, employment or prospects of work,
family ties, history, and the applicant’s long term intentions as demonstrated
by actions (like obtaining furniture, registering for services, joining
institutions). If the applicant is deemed not to be habitually resident in the
UK, they will not be eligible for assistance.

The test does not apply to certain applicants for homelessness help:
- European Union national workers
- other E U nationals, and those who are applying because they are nationals of
countries covered by other treaties
- refugees and people with Exceptional Leave to Remain, Discretionary Leave or
Humanitary Protection do not have to pass the Habitual Residence Test.

No person will be treated as habitually resident unless he or she has a right to
reside in the United Kingdom, the Channel Islands, the Isle of Man, or the
Republic of Ireland. People who do have a right to reside will still have to
satisfy the habitual residence test.
