The USCIS announced that, on Monday, April 2, 2007 (on the first day of the
filing season), it received sufficient numbers of H-1B petitions to far
exceed the standard H-1B cap for Fiscal Year (FY) 2008. To identify those
cases that will be awarded a FY 2008 cap number, the agency will use a
computerized random selection process. USCIS reportedly received a record
number of H-1B filings – 150,000 as of the afternoon of Monday, April 2, far
in excess of available numbers. Accordingly, a significant percentage of
filed cases will not be selected in the lottery. Cap-subject H-1B petitions
that are not randomly selected will be rejected and returned.
