A Lower East Side man serving a long prison term has received the most
precious gift this Christmas: clemency from Governor George Pataki.

The gift was part of a long-standing tradition in which the governor grants
early parole to a long-suffering prisoner for Christmas.

Darryl Best, 49, has been in prison since 2001 on a drug conviction. He
signed for a Federal Express package for someone else that contained cocaine,
but has always maintained his innocence.

He was sentenced to 15 years to life in prison under the state's tough
Rockefeller Drug Laws. In the spring, Best's sentence was reduced to nine
years in prison, with five years of post-release supervision, due to changes
to the laws.

On Saturday Pataki commuted his term, making Best eligible for release in
January.

It was the only act of clemency this Christmas for Pataki, who has granted
clemency 32 times since he became governor.

Best's wife and children live on the Lower East Side.
